TERMS OF LEASE

By ordering a dumpster from BACKROAD HAULERS, LLC, and providing your information to our representatives, you, the Customer, acknowledge receipt of and agree to the terms and conditions. Please review the dumpster rental terms and conditions below to see the details associated with your specific service.

BACKROAD HAULERS, LLC will provide a dumpster service using our roll-off truck. Service will be provided on the day requested. Cancellation of the booking is required no less than 8 hours before delivery to avoid a cancellation fee. The customer is responsible for any permits required by the HOA or city (if any). Blocking or impeding the retrieval of our containers on the agreed collection date will result in a dry run charge. Customers shall inspect the container upon delivery for any existing damage. Upon removal of the container, BACKROAD HAULERS, LLC shall be entitled to charge the customer for the cleaning, repair, or replacement costs attributable to any damage to the container while in the customer’s possession. The customer shall be liable for any repair or replacement costs up to the current market price. Upon removal, the customer authorizes BACKROAD HAULERS, LLC to collect any additional costs attributable to the customer.

Customers are responsible for the total weight of the contents of their dumpster(s). All customers are responsible for ensuring their dumpster(s) are not overloaded. Filling a dumpster above the top line of the dumpster will result in an unloading fee at the discretion of BACKROAD HAULERS, LLC. The weight included in the initial price for the 15-yard and 20-yard dumpsters is 2 tons (4,000 pounds). Exceeding the stated weight allowance will result in an additional charge over the stated weight allowance. The customer will not load debris weighing 6 tons (12,000 pounds) or more. Any weight above the maximum tonnage allowed will result in refusal of service, will require off-loading, and will result in a dry run charge. Loading of restricted and/or hazardous materials will result in refusal of service, will require off-loading, and will result in a dry run charge or a fee for unloading and proper disposal of the item at the discretion of BACKROAD HAULERS, LLC.

WASTE MATERIAL
Non-Hazardous Solid Waste Only and No Food Waste (unless a food waste dumpster is requested by phone). The customer agrees not to put any liquid waste or any waste that is, or contains, radioactive, volatile, corrosive, highly flammable, explosive, biomedical, biohazardous, infectious, toxic, and/or any hazardous wastes or substances (“Prohibited Waste”) into roll-off containers. Prohibited Waste includes, but is not limited to, tires (will be taken for an extra fee), wet paint (will be taken for an extra fee), appliances with freon (will be taken for an extra fee), batteries, ashes, oil, sewage sludge, etc. Do not load concrete, dirt, masonry, or roofing material without written approval from BACKROAD HAULERS, LLC.

INSPECTION/REJECTION OF PROHIBITED WASTE
Title to and liability for Prohibited Waste shall always remain with the Customer. BACKROAD HAULERS, LLC has the right to inspect, analyze, and/or test any waste placed in the rented dumpster by the customer.

ADDITIONAL FEES
NOTE: All of these fees can be avoided by ensuring proper loading and care is taken with the containers and by honoring other terms of the contract.
•   Cancellation (within 8 hours of delivery) = $150
•   Additional Rental Days = $20 per day for dumpster rental
•   Weight Exceeded = $100 per ton (prorated) over the weight allowance
•   Unloading Overfilled Dumpster = $150
•   Dry Run = $150 per occurrence
•   Sorting/Removal of Prohibited Items = $100 plus disposal fee per item
•   Unauthorized Moving of the dumpster = $100
• Dumpster swap-out request will result in a new dumpster rental period unless there is a different agreement between BACKROAD HAULERS and the renter.

ACKNOWLEDGEMENT
The customer acknowledges that BACKROAD HAULERS, LLC shall not be liable for any damage to any property resulting from BACKROAD HAULERS, LLC trucks serving containers in the agreed-upon areas and the surroundings. The customer acknowledges that they are not allowed to move around any containers with their equipment or a third party’s equipment. The customer acknowledges that they are responsible for any damages to the container during the period of the lease up to the full replacement cost of the dumpster or shipping container at current market prices.

PAYMENT TERMS
Prepayment at the time of reservation is required by debit card or credit card, BACKROAD HAULERS, LLC will keep that card on file until the account is at a zero balance. In the event a dumpster rental is invoiced, all invoices will be due the day the dumpster is delivered. The customer is responsible for late fees and all costs associated with recovering past due payment, including, but not limited to, legal fees and court costs.
